I believe it is one of those issues where by the guy gets shafted (and why men in general think they get screwed in a divorce / separation). The bottom line is that if he didn't pay the money into taxes than it would have been income coming into the family (which makes it a marital asset in 2008).
Yes especially if he claims you and your child as dependents. Make sure that you get an attorney unless your soon to be ex husband wouldn't screw you over because you might have to fight for it.
